Only the German version is legally binding. § 1 Provider The provider of the services is: Tabula Rasa Life LLC 23160 Fashion Dr Ste 220 Estero, FL33928 USA Email: mail@tabula-rasa.life The services are aimed exclusively at adult consumers. § 2 Types of contract Tabula Rasa Life LLC offers the following services: Digital products (e.g. e-books, online courses, downloads) Individual online consulting services (individual appointments) PART A – Digital products § 3 Subject matter of the contract (digital products) (1) Digital products are provided in electronic form. (2) They are provided immediately after payment. § 4 Right of withdrawal for digital products Information on the right of withdrawal Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the conclusion of the contract. To exercise the right of withdrawal, a clear statement by email to: Tabula Rasa Life LLC mail@tabula-rasa.life is sufficient. Expiry of the right of withdrawal For digital content that is not supplied on a physical data carrier, the right of withdrawal expires early pursuant to § 356 (5) BGB (German Civil Code) if the customer has expressly agreed that performance of the contract may begin before the end of the withdrawal period, and the customer has confirmed that they lose their right of withdrawal once performance begins. When the digital product is provided and this consent has been given, the right of withdrawal expires completely. PART B – Consulting services § 5 Subject matter of the contract (consulting) (1) The subject matter of the contract is an individual one-to-one online consultation via video conference. (2) The overall service includes: a) Evaluation of the questionnaire submitted by the customer b) Individual case analysis and preparation of content c) Carrying out the consultation (approx. 75 minutes) d) Written summary of the content discussed (3) The individual preparation is a separate component of the service. (4) The consultation does not constitute legal or tax advice within the meaning of German law. § 6 Right of withdrawal for consulting services Information on the right of withdrawal Consumers have the right to withdraw from this contract within 14 days without giving any reason. The period begins with the conclusion of the contract. A clear statement by email is sufficient to exercise the right. Consequences of withdrawal In the event of withdrawal, all payments will be refunded within 14 days. If the customer has requested that the service should begin before the end of the withdrawal period, they owe compensation for the value of the services provided up to the withdrawal (§ 357 (8) BGB). § 7 Early start of performance and compensation for value (1) The individual case analysis begins when the completed questionnaire is submitted. (2) In the ordering process, the customer expressly requests that performance begin before the end of the withdrawal period. (3) The service component "individual case analysis and preparation" is valued at 30% of the agreed total fee. (4) If withdrawal takes place after preparation has begun, the customer owes compensation for value amounting to 30% of the fee. (5) After the consultation has been carried out in full, the right of withdrawal expires pursuant to § 356 (4) BGB, provided the customer has previously expressly agreed to the early start of performance. § 8 Appointments (1) An appointment can be rescheduled free of charge up to 72 hours before the appointment. (2) In the event of later cancellation or non-attendance, the full fee remains payable. (3) After the statutory withdrawal period has expired, there is no entitlement to a refund, provided Tabula Rasa Life LLC is ready to perform (§ 326 (1) BGB). General provisions § 9 Prices and payment All prices are stated in euros. Payment is due immediately upon booking. § 10 Liability Liability is excluded for slight negligence, except in the case of breach of essential contractual obligations and damage resulting from injury to life, body or health (§ 309 no. 7 BGB). § 11 Applicable law The law of the State of Florida, USA, applies. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected (Art. 6 Rome I Regulation).
